Schenectady Firefighters Cancer Foundation FUNdraiser

RELEASE, INDEMNITY AND HOLD HARMLESS AGREEMENT

Upon registering for and being permitted to participate in this “Tennis and Pickleball Fundraiser” hosted by the City of Schenectady, the Schenectady Tennis Association, and the Mohawk Pickleball Club, I agree to the following:

Assumption of Risk.  I  am voluntarily participating in this “Tennis and Pickleball Fundraiser” with knowledge of the risks, hazards, and other dangers involved.  I accept any and all risks of injury (including death), accident, illness (including disease), property loss or damage arising from, during, after, or in any way connected to this event, whether the occurrence is on or off the pickleball or tennis courts. 

Release.  I hereby waive, release, and forever discharge the City of Schenectady, the Schenectady Tennis Association, and the Mohawk Pickleball Club, their officers, directors, agents, and volunteers (collectively the “Releasees”) from any and all claims for personal injury, death, accident, illness, or property loss or damage. 

Indemnification.  I, to the fullest extent permitted by law, shall indemnify, hold harmless, protect, and defend the City of Schenectady, the Schenectady Tennis Association, and the Mohawk Pickleball Club and Releasees from and against any and all liabilities, claims, damages, losses, demands, lawsuits, costs, and expenses, including, but not limited to, attorney fees brought as a result of my involvement in this “Tennis and Pickleball Fundraiser”. 

Financial Responsibility.  In the event that I require medical care or treatment for illness or injury sustained as a result of my participation, I agree to be financially responsible for any costs incurred.  

Severability.  If any provision of this Agreement is held invalid, illegal or unenforceable by a court of competent jurisdiction, the remaining provisions of the Agreement will nevertheless be fully valid, enforceable, and unimpaired by such holding.
